Call for Legislative Change to Compensate Heritage Property Owners

Members of the Odesa City Council have reached out to the Verkhovna Rada and the Cabinet of Ministers of Ukraine, requesting urgent legislative measures to address compensation for damaged property under the «eRestoration» program for residents of buildings designated as cultural heritage sites.

Apartment owners in the affected heritage buildings have the right to compensation according to the Law of Ukraine «On Compensation for Damage and Destruction of Certain Categories of Real Estate Due to Military Actions and Aggression by the Russian Federation».

However, the provision of compensation to residents of these heritage buildings through the eRestoration system is hindered by legislative circumstances, specifically:

firstly, the Cabinet of Ministers' resolution dated 19.04.2022 No. 473 states that compensation does not apply to cultural heritage sites, which complicates the documentation of damages in apartments and their registration;

secondly, the Cabinet's resolution dated 15.11.2022 No. 1342 does not regulate the compensation process but merely simplifies the procedure for obtaining permits for work on heritage sites during wartime.

Throughout 2024, the Executive Committee of the Odesa City Council has twice reached out to the Ministry of Culture and the Ministry of Community Development regarding amendments to these resolutions.

Nonetheless, this issue, which is of national significance, remains unresolved.

Odesa City Council members have once again appealed to central authorities for urgent legislative action to facilitate compensation for residents of cultural heritage buildings.
